What To Expect From The Brill Law Group

Personal injury claims do not resolve overnight. They take months and sometimes years to conclude. But that doesn’t mean you will just be sitting around wondering what’s going on.

When you sign up with the Brill Law Group, we will always keep you up to date with all developments in your case. You’ll be in the loop every step of the way.

 

Stages of Your Personal Injury Case

While every case is different, personal injury cases at our firm go through the following stages:

  • Investigation

1. Investigation

From the moment you sign up with our firm, we begin investigating your case. First, we take over all communications with insurance companies so you can focus on healing.

Next, we begin building up your case by collecting evidence. We obtain the police report, speak with witnesses, obtain video footage and photographs, hire experts, and collect insurance documents. Then we will find out how much insurance coverage is available for your claim.

 

2. Medical Care

While we are building your case, your job is to focus on healing. We can help you get the medical care you need even if you don’t have insurance.

The most important thing for you to do is be consistent with your medical treatment, follow your doctor’s orders, and not miss appointments.

 

3. Settlement Negotiation

Once you have completed your medical treatment, we obtain your medical records. We also get medical reports from doctors to prove the nature and extent of your injuries. If you missed time from work, we get your lost wages information, such as prior W2s and other employment documents.

We then craft a comprehensive and persuasive settlement demand to the insurance company.

The settlement demand consists of a written legal argument describing the other party’s culpability, the nature and extent of your injuries, and the long-term impact on your health and life. We support our demand with all the proof that we’ve gathered.

The insurance company reviews the demand, which may require several layers of supervisory review. Then, the insurance company submits an initial offer.

We respond to their offer and continue to negotiate until we’ve obtained fair value. If we believe fair value has been offered, we will recommend settlement. The decision of whether to settle and for what amount is ultimately up to you.

If you agree to settle, you will sign a release of liability to the at-fault party’s insurance company. They have 30 days from when you sign the release to issue the check.

 

4. Pay off your medical bills

After you have given us the authority to settle your case, we pay off your medical bills from the settlement funds. We want to ensure that you never get a “surprise bill” months later.

 

5. Tax-free compensation

Once we receive the settlement check, our fees and costs are deducted from the proceeds. The remaining balance of the settlement funds is then disbursed to you. These funds are tax-free; you don’t report them to the federal or state government.

You can enjoy your settlement funds in any manner you choose. Your case is then closed out, and you can get back to living your best life!

Will Your Case Go to Court?

A burning question you might have is, ” Will my case go to court?” This is completely normal, especially since you’ve never been through the process before.

The Brill Law Group has a unique approach to this question. Most law firms will sign your case up, file a lawsuit soon thereafter, and then wait 2-3 years before trying to settle your case right before trial. Not here.

At the Brill Law Group, we work extremely hard to settle your case without filing a lawsuit. By rigorously investigating your case and presenting an extremely persuasive case to the insurance company, we have a high success rate for obtaining fair compensation out of court.

However, sometimes the insurance company on the other side takes an unreasonable position and offers a lowball figure. We don’t get pushed around when the insurance company refuses to pay what’s fair by selling clients out for a quick payday.

The Lawsuit Process

When insurance companies don’t do the right thing, we file a lawsuit to hold them accountable. But this does not mean your case will automatically go to trial. At least 95% of lawsuits result in a settlement before trial. However, we are always prepared to go all the way to trial if necessary.

During the lawsuit process, we will submit documentation of your claim to the other party’s lawyer. They will submit documentation to us. We will then take their deposition under oath, asking questions about the incident and why they carelessly injured you.

Their lawyer then gets a turn to ask you questions in a deposition. A deposition occurs in a lawyer’s conference room, and there is no judge or jury – just lawyers and a stenographer. We will thoroughly prepare you to do an excellent job at your deposition.

Most cases settle after the client’s deposition. If yours does not, we will begin preparing for the trial. Some firms are only settlers and have no ability to try a case. Insurance companies know that the Brill Law Group is a trial law firm that isn’t afraid to go all the way.

Even during trial, many cases will be settled before a jury verdict is reached. However, in the rare circumstance where an insurance company refuses to budge, we ask the jury to force them to pay what is right.
